Adult Release of Liability, Waiver & Indemnity Agreement

It is the intention of undersigned participant by this agreement to exempt and relieve Champion Forest Baptist Church of Harris County, (hereinafter known as CFBC) and its officers, agents, servants or employees from liability for personal injury, property damage or wrongful death of the undersigned participant caused by any act of negligence of Champion Forest Baptist Church and its officers, agents, servants or employees.

For and in consideration of permitting the undersigned participant to observe, or use any facility or equipment of CFBC, or engage in and/or receive instruction in any activity or activity incidental thereto, some of which may involve dangers and risk of bodily injury at CFBC, in the city of Houston, County of Harris and State of Texas, beginning on the day of January 1, 2006, the undersigned participant hereby voluntarily and absolutely releases, discharges, waives and relinquishes any and all loss or damages or actions or causes of action for personal injury, property damage or wrongful death occurring to the undersigned participant as a result of the undersigned participants observing or using facilities or equipment of CFBC, or engaging in or receiving instructions in any activities some of which may involve dangers and risk of bodily injury or in activities incidental thereto wherever or however the same may occur, and for whatever period said activities or instructions may continue.

The undersigned participant for him/herself, his/her heirs, executors, administrators or assigns agrees that in the even any claim for personal injury, property damage or wrongful death shall be prosecuted against CFBC or its offices, agents, servants or employees, the undersigned participant will indemnify and hold harmless CFBC and its officers, agents, servants or employees from any and all claims or causes by action by said minor or by any other person or entity, by whomever or wherever made or presented and under no circumstances will the undersigned participant present any claim against CFBC and said persons for personal injuries, property damage, wrongful death or otherwise, caused by any act of negligence by CFBC and said persons.

I understand and acknowledge that by signing this document I agree for myself and my dependent children, if any, to the following terms, conditions, and covenants:

1. To abide by any and all rules, regulations, and procedures now existing or to be implemented in the future by the FAMILY LIFE CENTER (FLC).
2. To authorize any FLC staff member, if in their sole discretion it is necessary to administer first aid, contact family physician, call for emergency medical care or transport to a medical facility for treatment.
3. To forfeit any and all fees or other payments made to the FLC if my membership is cancelled or terminated for any reason. There will be no “refunds.”
4. To acknowledge that the FLC is not responsible for any articles left in the FLC.

The undersigned participant represent that he/she has read this Release, has requested and has been provided with, or has requested and declined advisement on the potential dangers/risks of engaging in this observation, activities or instruction offered, assumes all risk associated with such dangers and risks, and is fully aware of and understands the terms and the legal consequences of the signing of this Release. The undersigned participant intends his or her signature to be a complete and unconditional release of all liability to the greatest extent allowed by law and if any portion of the Release is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
